1. Our position
XposeGo shows content that venues upload themselves through MenuXpose, our software for venues, including photographs, menu descriptions, logos and other material.
We do not create, select, verify or license-check that content. Under our Terms of Service §3, each venue warrants that it owns, or is properly licensed for, everything it publishes, and is solely responsible for it.
We respect copyright and we act on valid notices. If you believe material on XposeGo or MenuXpose infringes a copyright you own or represent, this page tells you exactly how to tell us, and what we will do.
2. Designated agent
Notices under 17 U.S.C. § 512(c)(3) should be sent to our designated agent:
| Agent | Copyright Agent (position designation), registered with the US Copyright Office as DMCA-1080177, effective 10 Sep 2026 |
| Company | WayExpose, LLC |
copyright@menuxpose.com | |
| Post | Copyright Agent, WayExpose, LLC, 1401 Pennsylvania Ave, STE 105 #2394, Wilmington, DE 19806, United States |
| Alternate names on the registration | MenuXpose, XposeGo, menuxpose.com, wayexpose.com, xposego.app, xposego.com (as shown in the directory) |
| Copyright Office registration | DMCA-1080177, effective 10 Sep 2026 |
Email is the fastest route and is monitored.
copyright@is for copyright only. Other concerns, including inaccurate menu information, impersonation or unlawful content, go toabuse@menuxpose.com, which is a different process with different timings.
3. Sending a takedown notice
To be valid, a notice must contain all six of the following (§ 512(c)(3)(A)). A notice missing any of them may not be actionable, and we may ask you to resubmit:
- A physical or electronic signature of the copyright owner, or a person authorized to act for them
- Identification of the copyrighted work you say has been infringed. If several works on one page, a representative list
- Identification of the material you say is infringing, with enough detail for us to find it. A direct URL is best
- Your contact details: name, address, telephone, email
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law
- A statement that the information is accurate, and, under penalty of perjury, that you are the owner or authorized to act for them
§ 512(f): knowingly misrepresenting that material is infringing carries liability, including for the other side's costs and legal fees. Before sending a notice, consider whether the use might be licensed, fair use, or your own material posted by someone entitled to post it. If you are not sure you hold the rights, get advice first.
4. What we do when we receive one
| Step | Timing |
|---|---|
| Acknowledge receipt | Within 1 business day |
| Assess validity against §3's six elements | Within 1 business day |
| Remove or disable the material where the notice is valid | Expeditiously, with a target of 24–72 hours |
| Notify the venue, forward the notice, and explain the counter-notice right | With the removal |
| Record it, including whether it counted as a strike (§6) | At the same time |
We remove the specific material identified. We do not take a venue's page offline over a single photograph unless the notice covers the page itself. A venue's customers should not lose the menu because one image was wrong.
An image can exist in more than one place, and removal has to reach all of them
Removing the file we were pointed at is not the same as removing the material. Two features put a venue's photograph somewhere else, and a takedown that stops at the original leaves the infringement published:
| Where else it can be | What removal has to do |
|---|---|
| A 3D model generated from the photo. If the venue uses the 3D menu add-on, a dish photo is used to build a model that is then shown on the page | The model is removed with the photo it came from. A model built from an image we were told is infringing is not cured by deleting the image |
| A connected delivery platform. If the venue connects DoorDash, Uber Eats or Grubhub, its menu and photographs are sent there continuously | We stop sending it and request its removal there. We do not control that platform's copy. We can withdraw the material and ask, and a rights-holder may need to notice the platform directly. We say so rather than implying a reach we do not have |
Both are recorded with the removal, so the record shows what was taken down and from where.
We do not adjudicate. We are not in a position to decide ownership, license scope or fair use. We act on notices that meet the statute, and we restore material on counter-notices that meet it. Where the parties genuinely disagree, that is a matter between them, and the counter-notice route exists precisely for it.
5. If your content was removed: counter-notice
If you believe your material was removed by mistake or misidentification, send a counter-notice to copyright@menuxpose.com containing all four (§ 512(g)(3)):
- Your physical or electronic signature
- Identification of the material removed, and where it appeared before removal
- A statement, under penalty of perjury, that you have a good-faith belief it was removed as a result of mistake or misidentification
- Your name, address and telephone number, plus a statement that you consent to the jurisdiction of the US federal district court for your address, or, if your address is outside the United States, any district in which we may be found, and that you will accept service from the complainant or their agent
What happens next:
| We forward your counter-notice to the complainant | Promptly |
| We restore the material | Between 10 and 14 business days after forwarding it |
| Unless the complainant tells us they have filed a court action seeking to restrain you | In which case it stays down |
Point 4 is a real commitment, not a formality. You are agreeing to be sued in a US court. If you are not prepared to do that, do not file a counter-notice. Replacing the image is usually the better answer.
6. Repeat infringers: accounts are terminated
We terminate the accounts of repeat infringers in appropriate circumstances. This policy is a condition of using XposeGo and MenuXpose, and it is applied.
How a strike is recorded
A strike is recorded against an account when we remove material in response to a valid notice under §3. Specifically:
- A notice meeting all six elements, including the statement under penalty of perjury
- Not an incomplete or unsworn complaint
- Not a notice we assess as invalid, or that is withdrawn
- Not a notice successfully answered by a counter-notice where the material is restored; the strike is removed with it
Strikes attach to the account, not to an individual venue. An operator running six outlets is one account holder.
What happens
| Strike | Action |
|---|---|
| 1 | Material removed. Written warning, explaining this policy and the counter-notice right |
| 2 | Material removed. Formal warning, and a review of the account's other content |
| 3 | Account terminated. Public pages taken down |
We may terminate sooner where the infringement is blatant, commercial-scale, or where an account is plainly created to infringe. We may also decline to terminate where the circumstances clearly do not warrant it, for example a long-standing account with a single old strike and a good-faith dispute.
Termination means the account and its public pages. Data export and deletion follow the Data Retention & Deletion policy; billing stops immediately and any unused prepaid period is refunded.
Appeals
Write to copyright@menuxpose.com. A termination decision is reviewed by a person, not a process. If a strike is later withdrawn or answered by a successful counter-notice, it stops counting.
7. Trademarks and other rights
This page is about copyright. For trademark, right of publicity, or other intellectual-property concerns, write to abuse@menuxpose.com with the same level of detail. Those are not DMCA matters and the statutory timings above do not apply, but we assess and act on them.
8. Canada
The DMCA is US law. Canadian copyright operates differently, and Canada's notice-and-notice regime is not a notice-and-takedown regime.
We apply the process on this page to all content we host, wherever the venue is, because a single, published, consistently applied process is better for everyone than two. Nothing here limits any right you have under Canadian law.
9. Changes
We may update this policy. The current version is always at xposego.com/copyright.
